Real Estate

Property Purchasing Procedures
The procedures implemented in the purchasing process are as follows:
1. Sales contract
This contract is signed between the purchaser and the seller and also the agent who is mediating the sale. The contract will be arranged in two languages: -
The native language of the purchaser and Turkish (in compliance with consumer protection law and the Turkish civil code).
The contract will contain the following information:

2. Acquisition of Tax Number
A tax number, easily acquired from the local Tax Office Directorate, will be required (along with a copy of passport) for title deed registration application, the setting up of a bank account and utility subscriptions application.
3. Setting up a bank account
An account in any local bank is set up in the name of the purchaser; this enables monies to be transferred to facilitate payment for the property. It will also allow for additional payments (maintenance fees, utility and public service bills) to be made.
4. Granting Power of Attorney
It is normal practice (though not obligatory) for the purchaser to grant power of attorney to his or her mediating agent or an alternative trustee. This allows that trustee to carry out all transactions relating to the purchase of the property as well as applying for utility, public services and telephone subscriptions in the name and on behalf of the purchaser.
5. Title Deed Application
A ‘permission to purchase’ request is made to the local Title Deed Directorate and also the relevant military authorities (compulsory procedure in Turkish property law) within the provincial borders of the location of the property. The application made to the military authorities is a formality to ensure that the property is outside of a restricted or military zone – this can take between 3-5 months before approval is received.
6. Title Deed Transfer
After the permissions for the title deed transfer are granted from the official bodies, the seller completes the title deed transfer to the purchaser at the Title Deed Directorate through the medium of a certified interpreter. This transaction can also be carried out by the appointed trustees on behalf of the purchaser.
Property Taxes and Payments

Additional Payments
Electricity subscription: Together with the 100 euros subscription cost for the recently
completed property, 120 euros of gauge deposit.
Water subscription: Approximately 60 euros for the recently completed property.
Telephone Subscription: Setting Up Fee of approximately 5 Euros. (Only those with a residency permit can have a telephone land-line connected).
Property Tax: Is paid to the local municipality in 2 equal instalments (usually May and November) every year. Property tax rates are in accordance with the sum that appears on the title deed.
Housing: 0.1% Other Buildings: 0.2%
Land: 0.1% Unclaimed Land: 0.3%
If, for example, the Title Deed shows a purchase value of 100,000TL, then the annual property tax will be 100TL (payable in two equal instalments of 50TL).
Environment Tax: Approximately 50 euros paid once a year (the value is
determined by the local municipality).
Contribution to be paid to the building administration (Maintenance Fee): Monthly maintenance cost of around 30 - 100 euros for the caretaker salary, security, cleaning of external and internal communal areas, garden maintenance, pool care and maintenance, elevator maintenance, electric generator operating costs and other monthly maintenance costs. The monthly fee is determined according to the type of the property, site facilities and the building's service volume.
Utility Usage rates:
Electricity: Between 0.03 and 0.13 euros per KW (depending on the hour of the day).
Water: Between 0.3 and 1.5 euros per m3 (depending on operating facility).
There are water and electricity gauges in all residential units.
Title Deeds
There is one system of legal claim procedure implemented in respect of property ownership in Turkey; this system is administered by the Title Deed Directorate.
This is a Public Office that carries out all procedures relating to title deed issue and guarantees that these procedures are implemented with integrity and in accordance with the state law. Each and every purchase is assigned a uýnique registration number that will appear alongside the appropriate Title Deed registration. The documents will be held in the Real Estate Registrar's Office and copied to the Title Deed Directorate archives.
For the defined property, the ‘Title Deed' (TAPU) is the only document that proves capital ownership. The owner of the property can be one or more individuals or legal entities (e.g. companies).
Turkish public notaries are not entitled to carry out the purchase and sales of property and their registration records. The public notary can only certify a transfer (sales) contract that includes the determined prices and payment conditions of a property.

Pre-Sales Services
The Real Estate Agent in Turkey is the ‘ integrity’ guarantee of the transaction for both the purchaser and the seller.
Property Purchasing Advice:
All documentation relating to the unencumbered purchase of a property will be prepared by our personnel, in accordance with the laws that govern these procedures.
Pre-Contract Inspections:
The judicial status and actual condition of the immovable asset that is the subject of the purchase are inspected in detail by our personnel. These inspections are:
2) PLANNING PERMISSION ASSERTATION
To ensure that the immovable asset is located in a non-restricted zone, is not subject to a building development scheme and that there are no other expropriation processes involved.
3) THE CONSTRUCTION LICENCE CHECK
To ensure that the construction licence is compatible with the the architectural, electrical, sanitation and plumbing processes approved by the appropriate municipality.
4) QUALITY CONTROL
The quality of the construction of the immovable asset and all associated components will be checked.
5) CERTIFICATE OF OCCUPANCY CHECK
To ensure that the immovable asset has the appropriate occupancy licence, as determined by the appropriate title deed directorate within the relevant municipality.
After Sales Services
We offer practical solutions to ensure maximum comfort and peace of mind in your property and to ensure you can enjoy your new home from the very first day of occupancy.
Subscription services: On demand acquisition of utilities, public services, domestic (and mobile) telephone subscriptions on behalf of the customer.
Technical services: Management of property in the owners absence, bill paying and technical maintenance of the electricity, water, heating and cooling systems (where the owner has been informed and access permission obtained).
Cleaning: Cleaning and ventilation of the apartment where requested.
